Description
The client obtained legal permanent residency through their parent and wants to now apply for U.S. citizenship. They have multiple criminal convictions on their record, all of which occurred after obtaining legal permanent residency.
Strategy
The client is a U.S. citizen, and their fiancée was from Cambodia. They wanted to know the best route to get them to the U.S. and obtain legal permanent residency. Review all criminal documents to determine if they were eligible for naturalization. Then file the N-400 if criminal convictions do not render them inadmissible or deportable, and include an argument that supports their eligibility.
Challenges
Creating a timeline of events to determine if any of the convictions arose from the same incident, and calculating the days imprisoned from all convictions. We determined that the convictions did not render them inadmissible or deportable, but advised the clients of the risks of filing.
Outcome
The client was approved and is now a U.S. citizen.
