VAWA Approval for Abuse Survivor

Description
The client entered the U.S. legally on a work visa and later fell in love. They then married a U.S. citizen. The couple filed for the green card, and while waiting for the government to process the application, the client fell out of status. The spouse started verbally abusing the client and using their lack of immigration status against them. The client felt unsafe continuing the marriage and wanted to know what their options were and if they could remain in the U.S.
Strategy
File a VAWA application, and if approved, could get a green card and remain in the U.S.
Challenges
Proving they lived together and proving the verbal abuse. The client and their spouse only lived together for a brief period of time, and while they were living together, they were living with the spouse’s parents. Additionally, since all of the abuse was mental, we had to show how the abuse negatively affected the client.
Outcome
The client’s VAWA was approved, and later their legal permanent resident card.
