    Can my fiancé(e)’s children come to the U.S., too? 

    Yes. Your fiancé(e)’s unmarried children under the age of 21 may be eligible to come with them under a derivative K-2 visa.

    Can my fiancé(e) work in the U.S. on a K-1 visa? 

    After arriving, your fiancé(e) can apply for work authorization (an employment authorization document), which is valid for the 90-day period they are in the U.S. on their K-1 visa.

    What happens if we don’t get married within 90 days? 

    Your fiancé(e) must leave the United States immediately. The K-1 visa cannot be extended, and overstaying will result in a violation of U.S. immigration law and potential deportation.

    I am a green card holder, not a U.S. citizen. Can I petition for my fiancé(e)? 

    No. Only U.S. citizens are eligible to petition for a fiancé(e) with a K-1 visa. Lawful permanent residents must marry their partner first and then file a petition for a spouse.
