Description

The client came to us after being assaulted during a robbery. The police were called, and the client assisted in the investigation. They entered without inspection and wanted to know if they could get a status.

Strategy

File a U-Visa Certification with the police department handling the criminal matter. Once they sign off on the Certification, then file a U-Visa with USCIS.

Challenges

The main challenge was collecting all of the documentation needed for the U-Visa filing and completing the argument before the U-Visa Certification expired.

Outcome

After years of waiting (due to lengthy government processing times), the U-Visa was finally approved! Once the client has been in U-Visa status for 3 years, we can then apply for their legal permanent residency.
