Green Card via Religious I-601 Waiver

Description

The intending immigrant filed for adjustment of status based on being married to a U.S. citizen. They attended their interview with USCIS and were issued a request for additional evidence since the intending immigrant did not obtain the required vaccines due to religious reasons. USCIS requires that a waiver (I-601) be approved or the intending immigrant obtain the required vaccines before issuing a decision on the green card.

Strategy

File the I-601 waiver before the due date on the request for evidence. We included proof of their religion, that it goes against their religious beliefs to get vaccinations and the reason behind, and lastly, evidence of hardship to the U.S. citizen spouse if the intending immigrant were not allowed to remain in the U.S.

Challenges

The request for evidence only gave 30 days to respond. Additionally, the waiver needed to be filed at a different location, and then proof of the filing needed to be in the request for evidence response.

Outcome

The I-601 was approved, and subsequently, their green card was approved.
