USCIS stated that having a pilot shortage was not a reason that would meet the “national interest” portion of the EB-2 with NIW. We focused on the client’s previous experience with safety, foreign military operations, and training other pilots.
Outcome
The EB-2 with NIW has been approved. We are now waiting for a visa to become available before they can apply for the green card.
